Our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.
You agree to defend, indemnify, and hold harmless Finance Credit Connect and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in Douglas County, Nebraska for resolution of any disputes.

If we cannot resolve a dispute informally, you and Finance Credit Connect agree to resolve any claims through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.
EXCEPT FOR CLAIMS SEEKING INJUNCTIVE RELIEF, YOU AND Finance Credit Connect WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT.
Notwithstanding the arbitration provision, either party may bring an individual action in small claims court if the claim qualifies and remains within the jurisdiction of that court.
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY ARBITRATION OR PROCEEDING WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION.
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to the new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
No waiver by Finance Credit Connect of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms at any time without notice or consent.
These Terms, together with our Privacy Policy and any other agreements incorporated by reference, constitute the entire agreement between you and Finance Credit Connect regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
